The short version

This summary is for convenience. The full terms below are what apply.

  • You're in charge. ProCallable researches and makes calls on your instructions, and you're responsible for what you ask it to do.
  • Only call people you're allowed to. Calls to your customers need their prior express written consent. Business accounts may call other businesses, including to introduce themselves, if each call says it's from an AI assistant and you honor requests not to be called.
  • Prepaid, no subscription. Calls cost about $0.23 per connected minute on US numbers, plus research and planning at actual usage. Unused credit is refundable for 30 days after you buy it.
  • Calls play by the rules. It never claims to be human, warns about calling times outside 8am to 9pm where the person is, and honors do-not-call requests.

1. Who we are

ProCallable ("ProCallable", "we", "us") provides an AI assistant that researches businesses, places phone calls for you, and reports back what was confirmed. You can use it through procallable.com, its web app, and its API (together, the "Service").

These Terms of Use are an agreement between you and ProCallable. By creating an account, buying credit, or using an API key, you agree to them. If you use ProCallable for a business or other organization, you agree on its behalf and confirm that you're allowed to.

2. Your account

  • You must be at least 18 years old and able to enter into a contract.
  • Use an email address you control and keep your sign-in details secure. You need a verified email address to use the app.
  • You're responsible for everything done through your account, including through its API keys. If you think someone else has access, tell us right away at support@procallable.com.

3. How ProCallable works

You describe a task. The assistant looks up businesses and public information, places calls through our phone provider, and talks with the people who answer using an AI voice. It may ask you questions while it works, and it ends with a report of what was confirmed, what was attempted, and what is still open.

  • AI can misunderstand people or make mistakes. The report reflects what the other party said; we can't guarantee that a business will honor a quote, a booking, or anything else it told the assistant. Check anything important yourself.
  • Calls can fail: no one answers, a phone menu can't be navigated, or a call drops. You're charged only for the usage that actually happens.
  • We may limit how long calls run, how many calls happen at once, and how many calls an account can place per day.

4. Calls you're allowed to make

Only direct ProCallable to call numbers you have the right to call, for lawful purposes. You may not use it to:

  • harass, threaten, deceive, or defraud anyone, or to impersonate a specific real person;
  • call emergency services such as 911;
  • place debt-collection calls;
  • place telemarketing or sales calls to consumers without their prior express written consent, or any other call that needs consent you don't have;
  • call anyone who has asked not to be called.

Calls to businesses. A Business account may call other businesses at their business numbers, including to introduce its own products or services. Each of these calls must say at the start that it's from an AI assistant and which business it's calling for, and you must stop calling any business that asks not to be called. You're responsible for following the laws that apply, including the Telephone Consumer Protection Act and state telemarketing laws. For example, an AI or prerecorded-voice call to a mobile number, even one a business uses, generally needs prior express consent, and prior express written consent if it's a sales call.

The Service refuses numbers on the do-not-call list. It flags scheduled calls outside 8am to 9pm in the recipient's time zone but doesn't refuse a call over the time, so keeping to the calling hours the law allows is up to you. The assistant never claims to be human and answers honestly if someone asks whether it is an AI. You may not instruct it to do otherwise.

5. Calls to your customers

Customer calls, whether started in the app or through the API, are placed on behalf of you or your business. For each one:

  • You must have the person's prior express written consent to receive automated calls from you, and keep a record of it. You confirm this each time you start a customer call.
  • You're responsible for following the laws that apply to your calls, including the Telephone Consumer Protection Act and state calling laws.
  • Customer calls open by saying they're from an AI assistant. If someone asks not to be called again, their number is added to the do-not-call list and no further calls are placed to it.

You agree to cover any claims, fines, or costs that result from calls placed without the consent or other permission they required.

6. Purchases and commitments

  • You can set a purchase limit for orders and bookings. The assistant asks you before committing to anything over it.
  • Orders, bookings, and other commitments the assistant makes within your instructions and limit are made on your behalf, and you're responsible for them.
  • The assistant prefers paying at pickup or on delivery. It shares payment card details only if you give them to it during a call.
  • Any purchase is between you and the business. We aren't a party to it and aren't responsible for the goods or services you receive.

7. Prepaid credit and pricing

  • The Service is paid for with prepaid credit, bought through Stripe in the amounts shown in the app. There's no subscription.
  • Tasks draw from your balance as they run. Calls cost about $0.23 per connected minute on US numbers; calls to other countries cost more. Research and planning are billed at actual usage. Each task shows its costs as it runs.
  • A task can start only when your balance is at least $2, and a running task never spends more than your balance covers.
  • Credit has no cash value outside the Service and can't be transferred to another account.
  • We may change prices. The current prices are always on our pricing page, and changes apply only to usage after they take effect.

8. Refunds

You can ask for a refund of unused credit within 30 days of buying it. Email support@procallable.com from your account's email address, and we'll refund the unused part of that purchase to the original payment method.

Credit already used for calls or research isn't refundable, and after 30 days credit isn't refundable except where the law requires it. If a task fails because of a problem on our side, contact us and we'll restore the credit it used.

9. API keys and integrations

  • API keys, including keys used with MCP clients, act on your account and draw from your balance. Keep them secret; you can revoke a key at any time in Settings.
  • Everything in these terms applies to calls placed through the API. API calls always open by saying they're from an AI assistant.
  • We may rate-limit API use, and we may change or retire API versions with reasonable notice.

10. Your content and call records

  • You keep ownership of the instructions and files you give ProCallable. You let us use them, and the calls they produce, to run the Service for you.
  • To do that we rely on service providers: our phone provider (Twilio), AI model providers, Google (hosting, sign-in, our database, and maps lookups), and Stripe (payments). They process your content only to provide their part of the Service.
  • We keep each task's transcripts and report in your account, visible only to you. Card-like numbers are removed from saved transcripts. Call audio isn't recorded.
  • We don't sell your information. You can ask us to delete your account and its records by emailing support@procallable.com.

11. Acceptable use

Besides the calling rules above, don't:

  • break the law or help anyone else break it;
  • try to get around the Service's limits or its calling, consent, or do-not-call checks;
  • interfere with the Service, probe it for weaknesses, or access it in ways we don't provide;
  • resell the Service or share an account to avoid its limits.

We may refuse a task, stop a call, or suspend an account to protect people, the Service, or our phone numbers.

12. Disclaimers and limits of liability

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don't promise that a task will reach anyone or succeed.

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.

You agree to defend and indemnify ProCallable against claims arising from your instructions, your calls, or your breach of these terms.

13. Ending your account

You can stop using ProCallable at any time, and you can ask us to close your account. We may suspend or close an account that breaks these terms or puts people or the Service at risk.

If we close your account without a breach on your part, we'll refund your unused credit. Sections 5, 6, 12, and 14 continue to apply after an account ends.

14. Changes, governing law and contact

We may update these terms. We'll post the new version here with a new date, and for significant changes we'll also tell you by email or in the app. Continuing to use the Service after a change means you accept it.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, and you and we consent to their jurisdiction.
